Bad Debt Expenses(대손금)

대손금은 법인이 소유한 채권 중 받지 못하게 된 채권의 가액을 말하는데, 대손금은 그 자산성을 상실하여 법인의 순자산을 감소시키는 손비에 해당하므로 이를 대손금으로 손금에 산입한다는 것이 취지이다.
세법에 따라 대손금의 귀속시기는 해당사유가 발생한 날이 속하는 사업연도의 손금으로 산입하거나 해당사유가 발생하여 손금으로 계상한 날이 속하는 사업연도의 손금으로 한다.
 
The amount of irrecoverable claims due to grounds prescribed by Presidential Decree, such as bankruptcy of the debtor, among the claims held by a domestic corporation, shall be included in deductible expenses for the purpose of calculating the amount of income of the relevant business year.  
내국법인이 보유하고 있는 채권 중 채무자의 파산 등 대통령령으로 정하는 사유로 회수할 수 없는 채권의 금액은 해당 사업연도의 소득금액을 계산할 때 손금에 산입한다.
 
Irrecoverable claims due to grounds prescribed by Presidential Decree means the following.
"대통령령으로 정하는 사유로 회수할 수 없는 채권"이란 다음 각 호의 어느 하나에 해당하는 것을 말한다.

Accounts receivable and other receivables, the extinctive prescription of which has lapsed under the Commercial Act.
「상법」에 따른 소멸시효가 완성된 외상매출금 및 미수금

Bills, the extinctive prescription of which has lapsed under the Bills of Exchange and Promissory Notes Act.
「어음법」에 따른 소멸시효가 완성된 어음
 
Checks, the extinctive prescription of which has lapsed under the Check Act.
「수표법」에 따른 소멸시효가 완성된 수표.

Loans and advance payments, the extinctive prescription of which has lapsed under the Civil Act.. 
 「민법」에 따른 소멸시효가 완성된 대여금 및 선급금

Claims determined as irrecoverable based on the determination to authorize a rehabilitation plan or a court-ruling of discharge under the Debtor Rehabilitation and Bankruptcy Act.
「채무자 회생 및 파산에 관한 법률」에 따른 회생계획인가의 결정 또는 법원의 면책결정에 따라 회수불능으로 확정된 채권

Seized claims for which auction on the property of a debtor is cancelled under Article 102 of the Civil Execution Act.
「민사집행법」 제102조에 따라 채무자의 재산에 대한 경매가 취소된 압류채권

Claims accruing from export of goods or provision of services in a foreign country, which is exempt from the obligation to collect claims from the Governor of the Bank of Korea or the President of a foreign exchange bank under the Acts and subordinate statutes relating to foreign exchange transactions.
물품의 수출 또는 외국에서의 용역제공으로 발생한 채권으로서 외국환거래에 관한 법령에 따라 한국은행총재 또는 외국환은행의 장으로부터 채권회수의무를 면제받은 것

Irrecoverable claims because of bankruptcy of a debtor, forcible execution, execution of punishment, discontinuance of business, death, missing or unknown whereabouts of a debtor.
채무자의 파산, 강제집행, 형의 집행, 사업의 폐지, 사망, 실종 또는 행방불명으로 회수할 수 없는 채권

Checks, or bills in relation to which at least six months have passed since it was dishonored, or accounts receivable (limited to accounts receivable of small and medium enterprises, which have occurred before the date of dishonor).  
부도발생일부터 6개월 이상 지난 수표 또는 어음상의 채권 및 외상매출금(중소기업의 외상매출금으로서 부도발생일 이전의 것에 한정한다).
 
Claims, the value of which do not exceed 200,000 won (based on the total value of claims by debtor) among the claims for which at least six months have passed since the deadline for collection.
회수기일이 6개월 이상 지난 채권 중 채권가액이 20만원 이하(채무자별 채권가액의 합계액을 기준으로 한다)인 채권
